    Keeping Your Spanish Web Site Legal

    Hi All,

    We often pose questions to our law firm that represents us in any internet related matters in order keep ourselves and our own clients web sites legal.

    "What legal steps does a Spanish company that owns a web site in Spain, have to do in order to keep their web site within Spanish Law"?

    This was their response....(and some of you might be surprised a little). Although its not enforced with rigour, there can be fines of up to 30K apparently.

    The clients of the business (any web site visitor) shall be obliged to have at their disposal the necessary tools allowing them to obtain, by electronic means, easy, direct and free access to the following information :

    a)    The name or Company name; address of  residence or of one of their offices in Spain; e-mail address and all details which can help to get in touch with the business owner directly and effectively;

    b)    Details of the company inscription to the Commercial Registry or to each other Public Registry;

    c)    If the activity of the company is in connection to a previous administrative authorization, the details of that authorization and of the office in charge of the supervision;

    d)    If the business exercises a State Regulated profession, they have to indicate:

    - The details of the Professional College  as well as the collegial number;

    - The academic official title or profession with which the business trades with;

    -    The European  Union State or the Economic European Space in which that title was issued, and in that case, the related homologation or appreciation;

    -    The applicable professional rules of his profession and the middles by means of which they can be known, electronics includes;

    e)    Fiscal identification number;

    f)    When the web site of the business  contains price information, products or services,  it should be clear and exact and if it is VAT included or not, and in case of transport fees, mention the costs of transport;

    g)    In the case of a code of conduct, there must be clear links to this information;

    The obligation to forward this information should be considered fulfilled if the company include it in the web  site and in the indicated conditions.
